The federal appeals court has upheld a ban on sending state troops in Portland, Oregon, following a latest court ruling.

Judicial Panel Agrees to Rehear Case

The ninth circuit court of appeals ruled on this week that it would reexamine the case concerning the executive power with an expanded group of 11 judges. The judicial body also overturned a previous ruling from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Military Presence

This legal directive represents the most recent development in a protracted court case over whether the administration has the legal right and justification to send state military units in the city. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was started in response to ongoing demonstrations.

Differing Viewpoints

The federal government has argued that government employees at the immigration center in south Portland were facing threats, while city and state officials assert that municipal police have control of the situation.

In defiance of characterizations of Portland as a conflict zone, locals have been sharing footage of scenic paths and a thriving food scene, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city enacted two legal injunctions this period – one preventing the federal control of the Oregon national guard, and another prohibiting the use of any military personnel in the state, after efforts to circumvent the first order by calling up out-of-state forces.

On Monday, the appeals court had temporarily suspended the initial decision – allowing control of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the forces.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with all decisions under review together – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the courts are striving to hold this administration accountable. The founding document restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The judicial body is sending a definite signal: the president cannot send the military into US cities without cause. We will continue defending state legislation, principles, and sovereignty as this case moves forward and our fight continues in the judicial system.”
